By using the Qozgal app, you agree to these Terms. If you do not agree, please do not use the App.
These Terms of Use ("Terms") govern the relationship between Alippe Inc ("Developer", "we", "us") and any individual ("User", "you") who uses the Qozgal mobile application ("App").
The App is available on iOS and Android and enables users to track daily steps, maintain activity streaks, use streak "freezes", participate in a referral programme, and enter monthly prize draws.
You must be at least 16 years old to use the App. If you are between 16 and 18, you confirm you have obtained consent from a parent or legal guardian. By registering you represent that you meet this requirement.

You are responsible for the security of your account and all activity that occurs under it. Notify us immediately of any unauthorised use.
Each person may hold only one account. Creating multiple accounts to abuse the programme constitutes a breach of these Terms.
The App reads step-count data from platform APIs:
We only request step counts. We do not access medical records, diagnoses, test results, or any other health information. Granting permission is voluntary; without it the step-tracking features will be unavailable.
Important: Qozgal is not a medical device, medical software, or a substitute for professional medical advice. Step information is provided for motivational and informational purposes only. Do not make health decisions based solely on App data.
A "streak" is a consecutive sequence of days each with at least 10,000 steps recorded. A "freeze" lets you preserve a streak on a day when the target was not met.
Each user receives a unique 5-character referral code. When a new user registers using your code, you receive a freeze reward according to the current programme terms.
To enter a monthly draw you must reach 10,000 steps on at least half the days of the calendar month. Specific conditions and prizes are published in the App before each draw.
Draws are conducted for promotional and motivational purposes and do not constitute gambling. Participation is free; no purchase is necessary and no purchase improves chances of winning.
We reserve the right to remove any participant from a draw at any time without explanation and without any compensation or obligation on our part.
Winner selection is carried out at our sole discretion. We are not required to disclose our selection methodology, and any participant's subjective assessment of "fairness" does not constitute grounds for challenging the results. The Developer's decision is final and non-appealable.
Participation in draws is voluntary. If you do not agree with these conditions, you are free not to participate.
Step data is read directly from device sensors via HealthKit / Health Connect. Artificially inflating step counts through emulators, software simulators, or device manipulation is a breach of these Terms. We may employ technical and other measures to detect violations.
The App's core features (step tracking, streaks, freezes, the referral programme, and entry into prize draws) are provided free of charge. "Qozgal Pro" is a paid subscription that unlocks additional features, in particular extended activity analytics. Subscribing is voluntary and is not required to use the App's core features.
On iOS, the Qozgal Pro subscription is purchased and paid for exclusively through the App Store using your Apple Account. The subscription title, its length, and the current price (in tenge or another currency for your region) are shown on the purchase screen in the App before you confirm the purchase.
The subscription is auto-renewable. Payment for the next period is charged to your Apple Account within 24 hours before the end of the current period, and the subscription renews for an equal term unless you turn off auto-renewal before that time.
You can manage your subscription and turn off auto-renewal in your Apple Account settings (App Store → your profile → "Subscriptions"). To avoid being charged for the next period, you must turn off auto-renewal at least 24 hours before the end of the current paid period. Deleting the App from your device does not by itself cancel the subscription. We have no technical ability to cancel or change your subscription on your behalf.
All subscription payments are processed by Apple. Refunds are handled in accordance with the App Store and Apple Media Services terms. We do not accept or process payments directly and do not issue refunds ourselves. For any questions about payments, charges, and refunds, please contact Apple Support.
We may change the subscription price and the set of features it includes. We will notify you of any price change in the manner required by Apple's rules; such a change applies to subsequent subscription periods and, where Apple's rules require it, takes effect only after you agree to it. If you do not agree to the change, you may cancel the subscription as described in Section 8.3.
Apple is not a party to these Terms. These Terms are entered into solely between you and the Developer, and the Developer, not Apple, is solely responsible for the App and its content, to the extent set out in these Terms and permitted by applicable law.
The disclaimers of warranties and the limitations of liability and indemnification set out in these Terms apply in full to the Qozgal Pro subscription.
If the Qozgal Pro subscription is offered on other platforms in the future (for example, through Google Play on Android), its purchase, billing, renewal, management, and refunds are governed by the rules of the respective app store.
You agree not to:
All rights to the App, its content, branding, Qozgal logo, source code, design, and related materials are owned by the Developer and protected by intellectual property law.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for personal, non-commercial purposes in accordance with these Terms.
By uploading a profile photo or other materials, you represent that you hold all necessary rights to such materials and grant us the right to store and display them within the App.
You must not upload content that infringes third-party rights or contains offensive, obscene, or unlawful material.
The processing of personal data is governed by our separate Privacy Policy, which forms an integral part of these Terms. By using the App you also accept the Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OPERATION.
We do not warrant the accuracy of step data — it depends on the hardware capabilities and sensor accuracy of your device. We do not guarantee continuous, error-free operation of the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR:
The Developer's aggregate liability to you on any basis shall not exceed the amount paid by you for the App in the preceding 12 months (for the free App — zero).
You agree to defend, indemnify, and hold harmless the Developer and its affiliates from any claims, damages, liabilities, costs, and legal fees arising from: (a) your breach of these Terms; (b) content you upload; (c) your infringement of third-party rights; (d) your use of the App in a manner inconsistent with its intended purpose.
We may suspend or terminate access to your account and the App at any time without prior notice and without explanation, including but not limited to:
Upon termination by us, we have no financial or other obligation to you — including no obligation to return data or compensate for streaks, freezes, points, or any other in-app assets.
You may delete your account and all associated data at any time — in the App settings or by contacting support@qozgal.app.
After deletion:
Account deletion is final. Recovery of data after deletion is not possible.
The App integrates with Apple HealthKit, Google Health Connect, and authentication services (Apple, Google). Use of these services is governed by their own terms. We are not responsible for the actions, policies, or content of third parties.
The Developer is not liable for failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, epidemics, military conflicts, governmental restrictions, internet or cloud provider outages, and similar events.
We may update these Terms from time to time. We will notify you of material changes through the App or by email at least 14 days before the changes take effect. Continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of Kazakhstan. Disputes shall first be resolved through negotiation; if no agreement is reached, they shall be submitted to the courts at the Developer's place of business.
Where applicable law limits contractual choice of governing law, this provision applies to the maximum permissible extent.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
